GallanDigital respects the intellectual property rights of others and expects contributors and users of this platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), GallanDigital will respond promptly to claims of copyright infringement committed using the GallanDigital platform.

Filing a DMCA Takedown Notice

If you believe that content available on or through the GallanDigital platform infringes one or more of your copyrights, please send a written notice ("Takedown Notice") to the designated agent listed above containing the following:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit GallanDigital to locate the material (e.g., the URL of the product listing page).
4. Information reasonably sufficient to permit GallanDigital to contact you, such as an address, telephone number, and email address.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

Counter-Notification

If you believe that the material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with the designated agent containing the following:

1. Your physical or electronic signature.
2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or the Northern District of Georgia if your address is outside the United States), and that you will accept service of process from the person who provided the original takedown notification or an agent of such person.

Upon receipt of a valid counter-notification, GallanDigital will promptly provide the complainant with a copy of the counter-notification and inform them that the removed material will be restored in 10 business days. Unless the complainant files an action seeking a court order against the contributor, the removed material will be restored between 10 and 14 business days after receipt of the counter-notification.

Repeat Infringer Policy

GallanDigital maintains a policy of terminating, in appropriate circumstances, the accounts of contributors who are repeat infringers of copyright. If a contributor is found to have repeatedly posted infringing material, GallanDigital may, at its sole discretion:

• Remove all listings by the contributor.
• Permanently terminate the contributor's account.
• Withhold any pending payouts as permitted by the Contributor Agreement.

Good Faith

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages.

GallanDigital reserves the right to modify this DMCA policy at any time. Changes will be posted on this page with an updated effective date.
